The following is a legal agreement between E-MotionCards, Roanoke, VA 24015
and "you" the user of this Site. Please read this agreement.

By browsing and using this web site you acknowledge that you have read, understand and agree to be bound to these terms of service and comply with all applicable laws and regulations. Warranty disclaimers and other provisions that limit our liability to you are contained in this agreement.

Copyright information: All materials are protected by copyright, and owned and controlled by E-Motioncards. You may not publish, modify, transmit, participate in the transfer or sale of, reproduce, recreate new works from, perform, distribute, display or in any way exploit, any
of the materials in whole or in part, except as otherwise provided for in this Agreement. You agree that any copy of the materials you make or have in your possession shall be unaltered and shall retain all copyright and other proprietary notices contained therein.

Acceptable Use Policy: E-Motioncards issues the following policies in order to assure that its electronic greetings are used in a lawful and appropriate manner. The following conduct is prohibited on the service: sending - harassing, abusive or threatening messages, defamatory or libelous messages, sending messages in furtherance of unlawful, criminal or fraudulent activity, attempting to steal passwords or credit card information, attempting to conceal or misrepresent the identity of the sender.

If sender violates the above policies, E-MotionCards may disable the sender’s account without compensation or refund.

Causing the Site to be displayed in a frame of another website is forbidden.

Spam: You may not use this site to send E-cards to mailing lists or to send unsolicited bulk or commercial messages. In addition, the use of automated scripting type programs that automate the process of sending or viewing any of the materials is strictly prohibited. E-Motioncards reserves the right to limit, in its sole discretion and without prior notice to you, the number of cards or messages that you may send using this site and/or the number of recipients to which you send such cards or messages.

Limitation of liability: The materials, information, and services provided on this site are provided "AS-IS" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. There is no warranty against interference with your enjoyment of any materials, information or services (including, but not limited to, any data, text, images, sounds or against infringement. E-MotionCards is not responsible for any failure of electronic greetings sent through the service to reach their intended recipients or to reach such recipients on the date specified by the sender. The materials available on the site are subject to change without notice.

E-Motioncards nor any of its officers, employees, directors, or affiliates shall be liable for any direct, indirect, special, consequential, punitive, exemplary and/or incidental damages of any kind whatsoever (including, but not limited to, lost profits or attorneys’ fees in any way due to, resulting from or arising in connection with your access to, inability to access, or use of the site, or from your reliance on any information provided at the site. This limitation applies to all causes of action in the aggregate including, but not limited to, breach of contract, breach of warranty, negligence, strict liability, misrepresentation and any other tort. In the event the foregoing limitation of liability set forth herein shall be for any reason held unenforceable or inapplicable, you agree that E.MotionCards aggregate liability shall not exceed the amount paid pursuant to the terms of this agreement.

Any opinion, statement, or other information displayed or distributed through the site by any person or entity does not represent E-Motioncards.

E-Motioncards takes no responsibility or assumes any liability for any content uploaded or otherwise transmitted by you or any third party, or for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, indecency, lewdness, harassment, threats, abuse, or profanity you may encounter in using the site. You agree to hold harmless -MotionCards from all claims based upon communications or materials made available by you on the site.

Outside of US: E-MotionCards, nor any of its affiliates make any representation that materials on this site are appropriate or available for use in locations outside the United States, and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.

Sale Agreement Terms: E-MotionCards hereby grants you a limited license to use such E-cards and other features of the site as are from time to time determined at our sole discretion, to be available for members only.

You will be required to select a password to be used in conjunction with your e-mail address. Do not disclose this password to others or permit others to use your password so as to access the site.

Your purchasing a license does not commit E-MotionCards to the future maintenance or availability of the site nor to the release of further e-cards. The list of the e-cards may be modified at the discretion of E-MotionCards. The site may also change, suspend or close or any part or feature of the site, or restrict access to parts of the whole of the site without notice or liability.

Refunds will be given in the event of a technical problems which prevents you are using the site otherwise it is up the to discretion of E-MotionCards. Should your licence be cancelled or terminated, or the site closed for any reason whatsoever, refunds again will be at the discretion of the company.

You may cancel your license at any time. Your license will terminate on the date determinded by E-Motioncards according to the amount of the fee paid by you in accordance with the price list published on the site.

The e-mail address you submit must be your valid and current address. In the event you change your address it is your responsibility to notify E-Motioncards.

This agreement may be modified at any time and it is your responsibility to periodically be apprised of this document.

You are solely responsible for your actions and communications undertaken or transmitted using this site. Neither we nor our affiliates exercise editorial control over your transmissions; however, we do reserve the right to review your uploads and transmissions in order to ensure compliance with these terms.

IF THE CONDITIONS CONTAINED IN THIS AGREEMENT OR ANY FUTURE CHANGES TO THE AGREEMENT ARE NOT ACCEPTABLE TO YOU, YOU SHOULD CANCEL YOUR LICENSE. YOUR CONTINUED USE OF THE SITE NOW, OR FOLLOWING THE POSTING OF ANY CHANGES TO THE AGREEMENT, WILL INDICATE ACCEPTANCE BY YOU OF SUCH CHANGES.
